		<title>June 2011 - Super Injunctions – Commentary from Media Lawyer Charles Cook</title>
<description>The now infamous 'super-injunction' refers to a legal gagging order which prevents the media from reporting the detail of a story and as well as forbidding the mention of the existence of the injunction itself. One of the current injunctions concerns a married Premiership footballer who allegedly had an affair with a Big Brother star. The Big Brother star’s name can be reported in the press as can the fact the footballer in question plays for a Premiership team but other details cannot be reported in the media. Users reporting details of injunctions could be found guilty of contempt of court and sued for invasion of privacy. Those reporting false accusations could be sued for libel. There is a strong difference of opinion among legal experts in respect of these injunctions. Some have said that the widespread online speculation concerning the content of super injunctions and the celebrities behind them has rendered them pointless whilst others have warned that people publishing details online could face relentless legal action. The flood of recent Twitter tweets disclosing the exact names of the persons protected by the injunctions demonstrates the current loopholes in English privacy law. There is a fine line between privacy and a recent identity disclosure order against Twitter with the balance of Article 8 of the European Convention on Human Rights, which guarantees the right to privacy, and Article 10, which guarantees freedom of expression. Finding the middle ground may be a severe challenge. It remains to be seen whether the law will be reformed and whether the likes of Twitter will actually be able to identify the super-injunction whistleblowers. Media solicitor Charles Cook said: “an online blogger may be no match for a celebrity investing circa £150,000 in legal costs to cover up an elicit act”'</description>
